 Upholding The Presumption: A Win for First Responders with PTSD

A recent decision from the Workplace Safety and Insurance Appeals Tribunal (WSIAT) affirms the vital importance of Ontario’s presumptive    PTSD legislation for first responders.

In Decision No. 460/25, a veteran police officer diagnosed with PTSD was initially denied WSIB  benefits, with the Board citing disciplinary and personal stressors as the    cause. On appeal, the Tribunal ruled in favour of the officer, confirming   that decades of cumulative trauma from frontline policing remained a significant contributing factor to his condition — and that the legal presumption of entitlement was not rebutted.

This outcome underscores the need to ensure our systems properly protect those who serve our communities, regardless of workplace conflict or delays in seeking help.
